Short answer: an owner-operator's family inherits the truck payments along with the truck. Life insurance sized to the equipment loans, plus income replacement, keeps a widow or widower from selling the rig at a loss. Small fleets with partners need a funded buy-sell agreement, and fleets that depend on one person need key person coverage. Business-owned policies have their own tax rules, so set them up with your CPA.

Collateral assignment on a truck loan

Lenders sometimes require life insurance as a condition of financing. A collateral assignment gives the lender the right to be paid first, up to the loan balance, with the rest going to your beneficiary. It is often cheaper to assign your own term policy than to buy the lender's credit life coverage. Ask the lender whether an assignment of an existing policy satisfies the requirement.

Buy-sell for fleets with partners

If you own a fleet with a partner, a buy-sell agreement says who buys a deceased owner's share and at what price; life insurance funds it so the survivor is not forced to borrow or sell trucks. Valuation, ownership structure and tax treatment belong with your attorney and CPA; the policy just has to match the agreement.

The tax rule that catches business-owned policies

When a business owns a policy on an employee, the death benefit can lose its income tax exclusion beyond premiums paid unless the employee was given written notice and consented before the policy was issued and an exception applies; the business also files Form 8925 (IRC 101(j)). A transfer of an existing policy between owners can also trigger the transfer-for-value rule. When life insurance is taxable.

A simple starting design for a one-truck owner-operator

  1. Term equal to the equipment loans, for the loan's length.
  2. Term or permanent equal to several years of family income.
  3. If you are building toward retirement and can keep paying, a small IUL funded well, as the coverage that lasts after the loans are gone (IUL for truck drivers).
